Your Otter VIP membership will cost $29.99 per year. At the end of your billing term, we will send you a reminder to renew your VIP membership, but there is no obligation.
Can I Cancel Anytime?
Yes—you can cancel your VIP Membership anytime by contacting our Customer Service team at 1 (855) 688-7269 and asking to cancel your Otter VIP Membership. Even if you decide to cancel, you'll still retain access to VIP Membership benefits for the rest of the year, up to end of the month when you first signed on as a VIP.
Otter VIP Membership Terms and Conditions
These Otter VIP Membership program (“VIP Membership”) terms and conditions (“Terms”) are between you and Otter Products, LLC (“OtterBox” “us” or “we”) and govern our respective rights and obligations. Your use of the OtterBox.com website and your VIP Membership are also governed by the applicable terms, conditions, limitations, and requirements on the OtterBox.com website, including, without limitation, the following agreements linked below, all of which (as modified from time to time) are incorporated into these Terms. By signing up for a VIP Membership, you accept these terms, conditions, limitations, and requirements.
Benefits of the Otter VIP Membership
VIP Membership includes (a) a free gift with signup (ARV: $29.99), (b) ten percent (10.00%) off sitewide on purchases, and free express shipping on those purchases within the U.S. (please note that certain purchases may only be able to be shipped by ground because of their certain characteristics and warranty orders are excluded). In addition, OtterBox may, from time to time, send you offers for exclusive Otter VIP Membership opportunities. Products eligible for VIP Membership benefits will be designated as such on the OtterBox.com website by automatically applying your discount. OtterBox may exclude certain products with special shipping characteristics at our sole discretion. If only some items in your order are eligible for the benefits of the VIP Membership, you will pay applicable shipping charges for the ineligible items. Changing or combining orders, or changing your shipping address, speed, or other preferences may affect your VIP Membership.
Membership Cancellation
You may cancel your VIP Membership any time by contacting OtterBox Customer Service at 1 (855) 688-7269 and asking to cancel your Otter VIP membership. If you cancel within five (5) business days of signing up, we will refund your full VIP Membership fee, provided that we may withhold from your refund the value of the VIP Membership benefits used or received by you and your OtterBox.com account during this period. If you cancel your VIP Membership at any later time, you will continue to receive VIP Membership benefits for the remainder of the subscription and through the end of the month in which your then active VIP Membership period began.
Fees and Renewal
By enrolling in the VIP Membership, you agree and acknowledge that you are opting-in to an annual membership subscription and acknowledge that from time to time OtterBox may offer different membership terms, and the fees for such membership may vary. OtterBox will charge the eligible payment that you have provided us for the initial and recurring annual payment charges at the then-current VIP Membership program subscription rate, plus any applicable taxes.
If any problems arise with the delivery address or eligible payment methods we have on file associated with your VIP Membership, we will notify you via the email address associated with your online profile asking you to resolve the problem. Your VIP Membership and all associated benefits will be suspended until you have resolved the problem. If you fail to resolve the problem your VIP membership will be cancelled.
UNLESS YOU NOTIFY OTTERBOX BEFORE A CHARGE THAT YOU WANT TO CANCEL, YOU UNDERSTAND YOUR VIP MEMBERSHIP WILL AUTOMATICALLY RENEW AND YOU AUTHORIZE US (WITHOUT NOTICE TO YOU, UNLESS REQUIRED BY APPLICABLE LAW) TO COLLECT THE THEN-APPLICABLE MEMBERSHIP FEE AND ANY TAXES, USING ANY ELIGIBLE PAYMENT METHOD WE HAVE ON RECORD FOR YOU.
Limitations
The VIP Membership is intended for personal use only and you may not transfer or assign it. OtterBox may screen received orders for fraud or other types of unauthorized or illegal activity. We reserve the right to refuse or process an order or suspend or terminate your Membership due to suspected fraud or unauthorized illegal activity. We may send you email and other communications related to the VIP Membership and your VIP Membership subscription regardless of your settings or preferences related to your OtterBox.com account.
Modification
OtterBox may, in its sole discretion, change these Terms, the policies referenced in these Terms, including, but not limited to, OtterBox.com’s Terms of Use and Privacy Policy, or any aspect of the VIP Membership. OtterBox will notify you of any material changes in the VIP Membership (including any change in the VIP Membership Fee. If you do not agree with any change, you may cancel your subscription to the VIP Membership.
Termination by OtterBox
OtterBox may terminate your VIP Membership at our discretion without notice. If we terminate your VIP Membership, we will refund a prorated amount of your fee based on the number of full months remaining in your membership, provided that OtterBox will not refund any amount of the fee for termination related to conduct that OtterBox determines, in its sole discretion, violates any applicable law, these Terms or any policy referenced in these Terms, involves fraud or misuse of the VIP Membership. Our failure to enforce strict compliance with these terms does waive any of our rights.
Limitation of Liability
In addition to and without limiting other limitations and exclusions in OtterBox’s Terms of Use , in no event will OtterBox’s, its parent company, affiliates, subsidiaries, members, officers, managers, directors, employees, agents, successors, assigns, or any third parties associated with the VIP Membership (collectively, the “OtterBox Parties”) be liable to you or any third party for any indirect, special, incidental, consequential, liquidated, or exemplary damages arising out of or relating to the VIP Membership, whether arising out warranty, tort (including negligence), contract or any other theory of liability. In no event will the OtterBox Parties’ total liability, whether in contract, tort (including negligence), or any theory of liability, exceed the most recent VIP Membership fee you paid. This limitation of liability will survive cancellation or termination of your VIP Membership.
